I’m seeking some advice and legal perspective from folks who might have experience with car accident claims that should i hire an attorney for car insurance claim or not .
About two years ago, we were involved in a car accident that resulted in our vehicle being totaled. The other party hired a lawyer right from the beginning, and since then, insurance company and the other party lawyer have been in negotiations but haven’t reached an agreement.
Recently, my insurance company let me know that the case is moving towards litigation. They advised that I should expect to receive a summons in the mail, but it’s been two months and nothing has arrived yet. When I checked in with my insurance representative, they said to just continue waiting.I also received a notice from my auto insurance company making it clear that I must inform my insurance company immediately if I do get served, or else I could face legal consequences and auto insurance won’t cover.
Right now, I’m not sure which court would handle the case, or even where a summons might show up—especially since I travel frequently and might not always be home.
If anyone here has dealt with a similar legal situation after an accident, I’d really appreciate your advice. Should I consider hiring my own attorney at this point to track court filings and coordinate with my insurance company, since there hasn’t been a settlement and things are now moving to court? Also, what kind of lawyer would be best to consult for this, and does anyone have an idea of the possible costs? My insurance company said they won’t cover my legal fees.

When you receive the summons, send it to them. They will hire an attorney for you. Don’t overcomplicate this.
